Welcome to RateMySalon! These Terms of Service ("Terms") govern your access to and use of our website, platform, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
1. Platform Role and Disclaimer
RateMySalon is a discovery and review platform designed to connect clients with beauty industry professionals. We do not provide beauty services, nor do we process bookings or payments for services. Any arrangements, bookings, or payments made between a client and a stylist are strictly between those two parties.
We are not responsible for the quality, safety, or outcome of any services provided by professionals found through our Platform. You agree that RateMySalon bears no liability for any physical, emotional, or financial harm resulting from appointments made off-platform.
2. User Accounts
To leave a review or upload photos, you must create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for safeguarding your password and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms, including accounts that post fake, malicious, or spam reviews.
3. Stylist Profiles and Claiming
We compile publicly available information, including state cosmetology license records, to create initial directory listings for beauty professionals.
Claiming a Profile: Professionals may "claim" their profile by verifying their identity using their active state cosmetology license number.
Accuracy: While we use public data to populate profiles, we do not guarantee the ongoing accuracy, active license status, or qualifications of any professional listed on the Platform. Clients are responsible for verifying a professional's credentials before booking.
Removal: If you are a professional and wish to have your scraped directory listing removed or updated, please contact us at support@RateMy.Salon.
4. User-Generated Content (Reviews and Photos)
You retain ownership of the text and photos you post to the Platform ("User Content"). By posting User Content, you grant RateMySalon a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content in connection with operating and promoting the Platform.
Content Rules: You agree not to post content that:
- Is false, defamatory, abusive, or harassing.
- Violates another person's privacy or intellectual property rights (e.g., uploading photos you do not own).
- Contains hate speech or discriminatory language.
- Is a fake review (e.g., reviewing your own business or a competitor's business in bad faith).
We reserve the right (but have no obligation) to remove any User Content that we determine, in our sole discretion, violates these Terms.
5. Copyright and DMCA Policy
We respect the intellectual property rights of others. If you believe your copyrighted work has been posted on our Platform without authorization, please submit a DMCA takedown notice to dmca@RateMy.Salon including a description of the work, its location on the Platform, and your contact information.
6. Limitation of Liability
To the maximum extent permitted by law, RateMySalon and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform or any interactions with other users or professionals found through the Platform
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Maryland, and you hereby consent to the personal jurisdiction of such courts.
